As far as I can tell from your original post, over two weeks have passed since, according to you, you were locked out of the office. That's TWO WEEKS TOO LONG. I was getting witness statements within hours of separating from my work situation and I WALKED OUT. I had plenty of irrefutable proof before I walked out.

Every day that goes by is a lost opportunity. People change their minds, fear they'll lose their job, don't want to be bothered with the past...etc. etc.

Every day that goes by gives your ex-boss time to find anything and everything they can to derail you and it sounds like he is doing a very good job of it.

Last I heard you were on hold with the EEOC. For the life of me, IF what you've told us is accurate, I can't understand WHY you weren't burning up their phone lines.

I hope things turn out well and this attorney will take your case.

I've got statements from people already. And have had a few others contact me interested in coming forward as well. Yeh, he's spreading lies from the new girl. But that's just more examples of retaliation. He's burying himself. I've already spoken to EEOC and they have the info on their end. I just have to send in the paperwork I have for my end. Have to get it printed. Will try to get to the store today to have that done. Kind of hard to break away to do it when you've got a terminally ill husband.

First and foremost, I'm sorry about your husband, terribly sorry.

Until you get that paperwork in they will be unable to start an investigation and possibly the information you've given them so far will become less useful.

Kudos to you for getting the witness statements as they are very important. So is any and all documentation, no matter how ridiculous you think it may seem.

Hopefully this attorney can intervene on your behalf.

I truly don't mean to be harsh, Mrs1885. I just want you to be okay and fight fight fight! You're worth it.

This is the only thread I've ever "subscribed" to since joining city-data. I have been checking every day for a notice in my emails telling me something new has happened.

Ok, so the attorney says that under no circumstances should I file the EEOC paperwork until he's seen me. He said I have a lot more claims than I even knew of, both state and federal laws have been broken. Apparently once you file through EEOC and check off one box on their form, you can't go back and later sue for something else if you choose to go that route.

I'm meeting the attorney at 8:30 tomorrow morning. *deep breath*

From what you've posted I'm delighted to be wrong.

I'm so happy you've found an attorney. Is his fee going to be contingent upon recovery or award?

He said he's not worried about the fees right now. He feels I have a VERY strong case and said we'll deal with the money later. He does charge 1/3 of the settlement (ouch) but at least someone has decided this is worth pursuing and seems to know what he's doing.

No. We don't have HR there. Just the County Executive and that's who I went to three times and he did nothing.

It sounds like you have an action. HOWEVER, I'd be curious as to what you posted on your personal facebook page that they contend is a reason you were fired. You seem to admit you posted something you shouldn't have, although you've been pretty vague about what it was.

You worked for a government agency, so depending on in what capacity, maybe you have some 1st amendment protections there, but if it was a post about an individual (which it sounds like it was) maybe you don't.

Even if everything occurred the way you stated, the agency might be able to use what you wrote on fb (which apparently was public to some degree or they wouldn't know about it) as a pretext for your termination.

I would ask the attorney about filing a claim under the WhistleBlower Act. YOu may have a lot better, and quicker response from them.
