Not conceding that Adam Serwer is an unreliable reporter, nonetheless here is law professor Robert Chesney:

Lawfare › The NDAA and US Citizen Detention

This source also helpfully provides a statement from Senator Feinstein, the author of the amendment in question:

Maybe we can find understanding in Sen. Feinstein's explanation of her NDAA amendment - Democratic Underground

Much to my surprise, I'll admit, maybe we should have been talking about Santorum after all.

I guess we should have. A strong showing from the leader of the American Taliban.

I like Urban Dictionary's definition for Santorum. It's fitting.

Santorum 2012 = Huckabee 2008

Not even, really, since Huckabee won by 9 points over Romney's perennial 25% whereas Santorum only tied it. But Santorum's ongoing appeal is about equal to Huckabee I am thinking.

I believe Santoram will fade away when his prior fiscal voting record comes under scrutiny.

I'd agree it is more likely than not that Santorum is just another flavor of the week candidate, who happened to have better timing. Still, Huckabee and Romney both lost to McCain, as opposed to Huckabee losing to Romney, and in general I think the question for this year is whether Republicans will eventually settle for Romney, or instead whether they will rally around whoever emerges as the final Anti-Romney.

If Rick Santorum goes on to become the nominee and wins the presidential election, he will be the first gay president in American history. I mean lets be honest here, he's a huge closet case. Give it a few years and he'll make headlines for being in a hotel room with a male prostitute or buying something from a gay sex store with gov't funds.

If Santorum's views aren't wacko enough to keep him from being elected president, then I am truly living in the wrong country. I don't know that I'd be able to move though....
