One can file a civil suit any time that they want. It helps a civil suit when there is a criminal conviction, because criminal cases are a higher standard. However, it takes longer for civil cases to come to trial, so there is an advantage to file as soon as possible. The case likely won't come to trial before the criminal case.
Besides, Weiner can sue for damage to his reputation even if there is no arrest.

NO, PBS (not CNN) was hacked by supporters of Wikileaks. Not sure what connection they would have with Weiner though
