I have a feeling the jury is confused ... I would be. I would think "I have to be missing SOMETHING ... because there's NOTHING in the state's case to point to 2nd degree murder".
OMara is making some real good arguments for dismissal. If there is any chance at all, Nelson will probably consider it over the weekend, unless she becomes reasonable and takes the sequestered jury into consideration.

What he said was that, under the law, he doesn’t get a second bite at the apple, so he has to present all of his arguments to the judge before she rules so that she has a smorgasbord to choose from rather than a single argument that she might shoot down.
I don’t see any way this judge can do anything but direct an acquittal. If she doesn’t, it will clearly be overturned on appeal.
