The State is precisely setting out why Zimmerman had ill intent. He has contradicted his own statements time after time, he never identified himself as the neighborhood watch guy to Martin, there's minutes missing between his phone calls to 911. He stalked Martin, confronted him, a pursuit was involved, there was a struggle, and Martin is dead. It's true that Martin had as much right to protect himself as Zimmerman did. Just because Zimmerman had a gun that trumped Martin's fighting ability renders Martin ineligible to defend himself? Remember, Martin didn't know he was a neighborhood watch guy.
This Defendant was rightly charged. If Zimmerman is not acquitted, the jury may render a verdict of manslaughter, which is where the State really thought it would end up anyway.
There are a couple of points that are appealable, but the appellate court will consider whether error, if any is found, is harmless, meaning that the jury would have arrived at the same verdict anyway despite the error.
Finally, the State has brought out that the screaming on the tape stopped immediately after the gun was fired.
The jury needs to hear this, and I do not believe the Judge will grant this defendant's motion for judgment of acquittal.
There time to do that was before the jury, they couldn't. More speculation and nothing concrete that shows 2nd degree murder.
What about these points?
Why did the screaming stop right when the shot got fired? Why would Zimmerman be screaming as he was reaching and maneuvering and pointing the gun? Why was there no muffling of the screams at any point, or right before the shot since at that point Zimmerman claimed Trayvon's full body weight was on the hands pressed against Zimmerman's face?
In Zimmerman's account to his best friend, he swore that he was attempting to scoot off the sidewalk as Trayvon was above him with his knees to Zimmerman's armpits yet at the same time Trayvon supposedly noticed the gun and went for it, which is physically impossible. Trayvon would have had to have had eyes at the back of his head and reach behind him to get the gun.
There were no instructions from the police. A dispatcher is not a LEO! Wow he continually lies about the facts.
So, by your logic, Law Enforcement would have told Zimmerman to follow Trayvon Martin? That's interesting.
The guidelines of Neighborhood Watch are very clear. Zimmerman chose to ignore them.
Quote:
“What do you tell someone about following someone?” prosecutor John Guy asked Dorival, a civilian police employee who works with Neighborhood Watch volunteer organizations.
Okay...came back to edit. I did not realize that you were taliking about something the prosecution said. Did they say that? I did not hear that part. Nevertheless, Zimmerman overstepped bounds and the 911 operator knew what they were talking about. No one would have asked him to pursue and in fact, on the contrary.
The state’s argument for second degree murder could be made against every police officer that has ever had to shoot a perp in the line of duty.
1. The shooting itself is sufficient evidence to find a depraved mind.
2. The defendant had access to information about self defense so he could have constructed a lie.
Zimmerman was not the police, he only thought he was.
All parties would have stopped at the sound of the gun.
Any assault would have ceased at that very moment, no matter who was screaming.
Why would Zimmerman have been screaming while he was getting to his gun, positioning it, making sure his left hand was out of the way, as he illustrated to police in the video interview, aimed and fired?
He claims he kept shouting for help even after Trayvon was down because he didn't know he was dead, so why can't we continue to hear him? Because his yells were not loud like Trayvons were maybe.
Why were the screams not muffled before the gunshot since at that point Zimmerman's mouth and nose were being pressed on with Trayvon's full body weight, according to Zimmerman?
I'd like someone who believes Zimmerman's version to answer these questions, even if you're just speculating.
All parties would have stopped at the sound of the gun.
Any assault would have ceased at that very moment, no matter who was screaming.
You're forgetting that Zimmerman claims he didn't know he'd killed Martin so, if he was screaming for help, why would he quit yelling for help when the gun went off?
