One possible reason - he was out on bail. Any arrest would cancel his bail, and send him back to jail, to await trial on the previous charges.

A long time ago a guy tried to choke me in the shower room. I half strangled (cut off carotid flow to his brain) him with my towel until he fainted. When he regained awareness I told him if he tried that again I would kill him. He believed me.

BTW - This was in 'Nam and I was not particularly civilized and he was a REMF.

In the case above I do not believe the officer was trying to kill this guy. The death was caused by lack of proper first aid by the cops and the ambulance personnel.

Again I ask, at what point was he ever told that he was under arrest?

IMO.......before the video started.

It was likely one of the first things said to Garner.

But none of us have proof...so a lot of assumptions are being made. Until I see any proof, I stand by my question.

They were in the process of cuffing him. Why did he resist arrest? Why did Michael Brown assault Darren Wilson?

I don't think I'd be chokin' somebody if that wasn't the idea.

If you can talk, you can breathe.

I'd squeeze harder.
