Technically a horse and a palm tree cannot give consent, so they couldn't have a Civil Marriage.

A horse could.

Well, that's a novel legal theory. Please let us know which precedents and/or which legal construction is the basis for it.

Because saying Sister NewAge or Father Friendy said so therefore this is the Catholic position is the equivalent of Speaker Pelosi saying the Catholic church supports abortion on command

Stop comparing behavior to a person's race.
Being gay has nothing to do with behavior.

Who said there was a right to same sex marriage under our current Constitution?

Nothing in the Constitution gives any court authority to rewrite or nullify any law.

Yes. That is why the Constitution is amendable.

It was designed exactly that way.

Actually the Constitution doesn't specifically say anything about marriage because it falls under a fundamental right. It does however say we are all treated equally, and denying people the right to marry due to their sexual orientation is not trying people equal, therefore denying them their right.

So that would mean those laws that deny people their rights are in violation of the Constitution and should be removed from law.

Equal rights doesn't mean equality in EVERYTHING. If it did then it would not be fair that a select few people get admitted to a school like Westpoint, and other people who do not have the means to be sponsored by a Congress person don't get to attend.

That has nothing to do with equal rights. Equal rights and equal representation by the government is not contingent on sexual orientation.
