Well, the truth is, I don't leave tips in hotel rooms when the housekeepers are obviously illegal. I also refuse to give money to homeless people who are illegal, though I sometimes do give money to homeless Americans.
My father took the citizenship test after LEGALLY coming to the US. I know the amount of limited English needed to pass that test. If someone can't speak a word of English they are obviously illegal.
If this waitress speaks English, I wouldn't assume she's illegal, though some people who are not obviously illegal can still be illegal. But if someone already comes across as illegal, then they are definitely illegal.
