It was never the function of teachers to pass judgment. The function of a teacher is to provide instruction and constructive criticism.
That's exactly what it sounded like he did to me.

What kind of child thinks of protesting the flag at school over their race? Doing the pledge is just a fun little exercise you do along with your classmates in a normal student's mind. I bet you this student is just a thorn in the class's and teacher's side in general.

It is basically a "First Amendment Retaliation" Complaint. These have been litigated before with success.

Yeah you win your case for being "First Amendment Retaliated" against usually just as long as your speech is leftist oriented and you're not a member of the white identity group. It's just like with EEOC complaints.

Boo-hoo. The brat is simply ticked that the teacher responded.

Call it a "teachable moment." As an adult, she'll see a lot of that.
