But the DC Circuit did not appoint a lawyer as amicus to defend Judge Sullivan's actions, unlike in Fokker.

Instead, the DC Circuit ordered Judge Sullivan to PERSONALLY respond and defend his actions, without an amicus attorney to do it for him.

This means that Judge Sullivan (and presumably his clerks) will have to PERSONALLY submit written briefing trying to legally justify his refusal to dismiss the Flynn case.

The DC Circuit is thus making Judge Sullivan--a lifetime federal judge--publicly and directly explain to them his actions.

In short, of all the options available to the DC Circuit for ruling on @SidneyPowell1 's writ, the DC Circuit, chose the most extreme, rare, and drastic of them.

It’s been asked/suggested that Sullivan could escape this Order by accepting the Prosecution dropping the charges and just dis,is the case now. What I’ve read by the Appellate Attorneys is that won’t stop the Circuit Court Order to Judge Sullivan. He totally Jumped the Shark and is in deep water.
The part in red is incorrect. The writ of mandamus seeks a mandate that the trial court dismiss the case. Such a mandate would moot the other relief requested by Flynn.

If Sullivan dismisses the case, the mandamus proceeding is over. There is no longer a case or controversy in the DC Circuit Court. It will have no jurisdiction. If Sullivan dismisses the case, the DC Circuit cannot make him answer questions or do anything else.


The part in blue is also incorrect. The "most severe" action the DC Circuit could have taken would have been simply to grant the requested relief and order Sullivan to dismiss the case without having a chance to explain himself beforehand.

Still denying that hillary PAID for Un-substantiated "dirt" on Trump which was used to go before the FICA courts, MULTIPLE TIMES to START the mueller "investigation which did NOT recommend ANY actions against Trump, even WITH a staff filled with DEM lawyers, some who worked for the hillary campaign and others who "donated" to her campaign.

It's been admitted by the Obama Intelligence liars that there was no Russian interference in our election other than Hillary hiring Russians to make up fake dirt on Trump in order to spy on him and then they used that false disinformation dossier to attempt to depose the President.

Since Russia did not attempt to interfere in our election in 2016, I hope they do in 2020 to ensure Trump's re-election.

There were several reports explaining, in detail, how Russia interfered with the 2016 election and favored Trump in doing so. Sticking your fingers in your ears and pretending it doesn’t exist won’t change that fact.
