My days in green are a while back (and in another country's armed forces, natch), but yeah - refusing an order from someone you recognize as a superior has to be on the content of the order. The Lt. Col. isn't just challenging the president. he's challenging everybody in the chain of command above him, starting with his CO. Which is also where it will end.

Teacher: "Please turn it in now."
Student: "I did it but I am not going to show it to you.
Teacher: "Excuse me, let me have it right now."
Student: "I will show you a note from my parents that states that I did it."
Teacher: "That won't do, I need to see the actual assignment."
Student: "You'll just have to take my word for the fact that I did it."

And so on and so on and so on... Get the idea?



What an awful analogy. The simple fact is he has publicly produced his birth certificate, something no other President has ever done. Yet the birthers still don't believe it.

The Presidents Birth Certificate has nothing to do with his orders unless they were signed by the President

Very likely. He has ended his career. This legal argument is off in the Hitler arena. He will be convicted. But that is just the start of the legal battle. (But courts martial are different from criminal courts.) This is an act of Honor on the officers part. He has said that he can not honorably follow his orders. He is taking the consequences for following his conscience, honorably.

His discharge won't, most likely, be honorable.
False honor is egotism; or in this case, cowardice.

Bull crap! He has reported for duty everyday until the Army revoked his access pass to the Pentagon and read him his Miranda Rights. From January 20, 2009 till this week, he has been obeying the same orders from the President that he always has - using his logic about orders originating from the CINC. You can't argue that you will accept some orders but refuse others solely based upon the question of the order givers authority.

Iraq in September of 2009.

Captain Rhodes does not seek a discharge from the Army; nor does
she wish to be relieved entirely from her two year active service
obligation. She has not previously made any official complaints
regarding any orders or assignments that she has received, including
orders that have been issued since President Obama became Commander
in Chief. But she does not want to go to Iraq (or to any other
destination where she may be in harm’s way, for that matter). Her
“conscientious objections” to serving under the current Commander in
Chief apparently can be accommodated as long as she is permitted to
remain on American soil.
