Okay, I just read the article about this in the Tallahassee newspaper and it said he was shot in his garage and his keys were still in his Honda Accord's ignition. I think it was road rage! Someone was mad, followed him home and shot him when he got out of his car! That's my opinion.
Wow, I didn't even think about that. Even when I lived in a house with a closed double garage, I NEVER left my keys in the car. You may be on to something.
I would also say a disgruntled colleague and yes also have the theory of the ex wife or girlfriend who might have thought she was the "one " and found out that she was not . This is really sad because what a brilliant legal mind cut short , now his sons will grow up without him .I think it is so sad when kids have to grow up without a father and to loose a parent to such brutality . It truly is sad . I pray that they find the culprit and put them away for good .

Again, I think this is the biggest clue. Here's an online, informal poll about whether people leave their keys in the ignition in the car even in a home (closed) garage:
86% would NEVER leave their keys in the ignition. On that site, someone also posted that surely he would need his house keys to get inside. I keep all my keys on the same key ring. Maybe some people don't.
But I think someone did stalk/follow him -- either that, or the road rage scenario. He didn't even get inside the house; from what I have read and understood, he was shot in the garage. "No forced entry" doesn't mean he necessarily entered the home -- at all.

Re girlfriend, not likely IMO. The above update link in my last post says new woman was an NYU professor. It's also not likely IMO that such a short relationship (he only divorced less than a year ago) could result in a murder that would like have taken a considerable time of premeditation, especially if it's a hit. A disgruntled student or colleague, what could they gain from his death? I really don't see a fail grade or his academic views warrant enough hatred for such a killing--even though crazy and radical people do exist, the ex-wife is still the one that would have the strongest motive.
If it's road rage, someone would likely have seen something happening on the road involving the two cars. It's also a scary thought, that someone could follow you home and shoot you execution style for road rage.
NEW update: ABCnews.com says he was pulling into his driveway and on his cell phone (maybe calling the police?) when this car pulled in and the person shot him. To me, that is road rage. Keys still in the ignition. I doubt his car was even turned off yet! Horrible.
