Chlorine concentration was observed at 200ppm. When manager was advised, she stated that Burger King's policy is that 100-200ppm is acceptable. Also, Burger King's policy on time as a control is not in compliance with the food code that the Virginia Department of Health follows. The inspection report was not given on the day of the inpsection. It was faxed on 6/2/08 at 9:20 am for manager's signature and return fax.

Provided employee health reporting agreement template.
An approved employee health policy is required to be adopted no later than April 16, 2008 which shall require food employees and conditional employees to report to the person in charge: 1). When they are experiencing any of the following symptoms: vomiting, diarrhea, sore throat with fever, jaundice, and any lesions containing pus such as a boil or infected wound that is open or draining and is on the exposed portions of the arms, hands, or wrists; 2). Diagnosed illnesses caused by: Salmonella, Shigella spp., E.coli 0157:H7, Hepatitis A Virus, or Norovirus; and, 3). Potential exposure to: Salmonella, Shigella, E.coli 0157:H7, Hepatitis A virus, or Norovirus. Based on the information given, the person in charge shall then restrict or exclude the employee from working as a food employee. The person in charge is responsible for reporting to the Health Department if a food employee reports a diagnosis with a listed pathogen.
If concentration of Chlorine in sanitizer compartment of 3 compartment sink exceeds 200ppm the Chlorine becomes a toxin. Desired range for Chlorine is 50-100 ppm EHS to follow up on the accuracy of the manfacturer's guidelines on Burger King sanitizer packets by calculating the volume of the basin at this food establisihment.
Bottles of chemical cleaners MAY NOT be stored above clean dishes on drain board, which exposes the clean dishes to potential contamination. Manager stated that this is the "required setup" but did not provide evidence explicitly showing that cleaning agents must be stored DIRECTLY ABOVE clean dishes per either Burger King or Ecosure Policy. Regardless, this setup constitutes a critical violation of state code and WILL be debited as such if observed.

October 31, 2007 (Follow-up)

Comments:
During routine inspection on 10/29/07 2 out of the 3 handsinks were not in service. During follow-up inspection on 10/31/07 verified that 1 of the 2 non-functioning handsinks has been repaired and is working properly. Third handsink is to be repaired within a week because the repair involves a lot of maintenance. Manager is to call EHS when third sink has been repaired.
