from what i've read it seems that cuban jus sanguinis laws are not automatic. cuban citizenship has to be applied for, reviewed and granted before a person receives citizenship. it would seem that cruz had possibly been eligible for cuban citizenship but never actually received that citizenship.

True. Most likely Cruz was born both a US and Canadian citizen, and not Cuban, as well.

59 Pages of posts so far, Alan Grayson saying he will file the lawsuit if Cruz is the candidate and a poll out of Iowa this week showing, I believe, 15% saying it might be an issue.

All you need is a little doubt...

And, even a quarter of the GOP thinks he doesn't qualify: Reuters Poll: Quarter of GOP Think Cruz's Birthplace Disqualifies Him for President

The big concern is with the question not officially answered, anyone voting for him may end up just throwing away their vote and that might not be something they want to chance doing.

I read the lawsuit. It is improperly drafted. Also the Court will predictably avoid adjudication on the grounds of either:
  1. Standing;
  2. Ripeness;
  3. Hypothetical question;
  4. Advisory opinion; or
  5. Political question
Those are typically grounds which courts use (along with, where applicable, mootness) to avoid adjudicating a matter for which courts are poorly equipped to handle or the ruling on the merits would be improvident.

I have personally lost a much-better grounded lawsuit (for a client) on the issue of ripeness, in a publicly reported decision. On a selective basis, i.e. with posters whom I have had satisfactory prior correspondence I will forward the decision.
