Is Abortion Murder? If Abortion Was Illegal...
If laws were legislated to prohibit abortion, some (women) will continue to have abortions and some people will perform abortions.
If these people are caught, would do you think the punishment should be for
- the woman who has the abortion
- the person(s) performing the abortion.
What charges should be brought against them? Murder?

No it isn't murder.

People would just go to where it was legal to have the abortion, even if it means leaving the US.

Maybe one reason why abortion will remain legal is because if abortion were illegal by law no one would know what to do next. I guess the anti-abortionists would stand around with their hands in their pockets and look at their shoes.
Unless those anti-abortionists who have a idea of what to do about step two, there is little point in trying to achieve step one.

The death penality!

What is the punishment for an illegal medical procedure?
Come to think of it what medical procedures are illegal?

It depends.

If one is considering the current laws of various states and the federal government, most abortions are not “murder”. If you are talking about the moral codes of the Bible (as a religious example), then it clearly is. If the Bible is really true (or whatever religious code one uses), then those who have and/or commit abortion will accordingly answer for it as a murder when their judgment time comes as it is the taking of a human life according to those scriptures.

That then begs the question, which laws do we adhere to (again, using the Bible as an example since it is so prevalent in our society)?

All citizens of a state or country are obligated to obey the laws of the land, except when a current state or federal law is violated with respect to taking the life of a child. Then, when that occurs, that person is held accountable. If such a “law of the land” conflicts with the Bible (for example, if women were required to have an abortion after their first child), then that person would stand on the Bible and accept the legal consequences of their actions.

However, since abortion is currently completely voluntary, there are no such conflicts. And, since abortion is voluntary, people are perfectly free to stand on Biblical grounds with respect to the subject and refuse to have any part in them.

You're sidestepping the bigger question if it should be illegal...It's a fallacy of Ignoratio Elenchi that the argument has validity in determining the punishment for a crime, but the base assumption of the arguement is not valid in that it is a crime. Only those with anti-abortion views would consider the base assumption in a way to get a good response.

I believe that abortion is murder, and here in England we have one of the highest abortion rates in the world, and it's rising.

As to the punishment for an illegal abortion, I have no answer, but the society that legally exterminates its most vulnerable and helpless is not a society at all and it has no business sitting in judgement on the Third Reich.

voluntary manslaughter, excepting cases where developing pregnancy poses the threat of death to mother prior to 24 weeks gestation or rape/incest. It should be left up to the states to decide, not federally mandated.

What precisely do you mean by "incest"?
This has always confused me.
If a woman consensually chooses to screw her brother/father/uncle/whomever, then why should she have the right to end her pregnancy, a right which you would not extend to any other woman?

And if you're talking about non-consensual sex between family members, then doesn't 'rape' cover it?
