No it wouldn't. Please read my first two posts in this thread (#37 and #39). There is no "statutory rape" in Virginia in the same sense that other states have it. The Class 1 misdemeanor to which Morrissey entered an Alford plea is Virginia's penalty for an adult having sex with a 15-17 year-old. It's the same penalty as reckless driving. Maybe we should call it reckless [redacted]

Delinquency of a minor is used on anyone under the "age of Majority", it has nothing to do with legality of sexual consent.
She was above that age, otherwise he would have been charged with statutory rape.
He was likely charged with delinquency of a minor because he took her to a hotel room.

Good for him becoming an indy. Maybe he realizes that both parties suck. That doesn't change that he was previously elected as a Democrat and since the kid is 9 years old it stands to reason that he was a Democrat at the time of the teenager got pregnant.
