Is there a policy, a terms of service if you will, for obtaining a press pass? If not, there should be. If there is and he violated those terms of service then he should have his press pass revoked if that is what the policy calls for. This shouldn't be complicated. There is no reason for this to be a 1st amendment issue.

No need to keep fighting it. Acosta 1, Trump 0. Trump should just take this huge loss from Jim Acosta on the chin and move on. No need for WH to keep fighting since the temporary decision is to reinstate for Acosta.
I remember Ronald Reagan doing evening press conferences back in the 1980s. I am also remember reporters like Sam Donaldson acting they were public prosecutors and the President was a criminal defendant on trial.
They often went a bit too far, and it may be a major reason the following Presidents (Bush Senior and Bill Clinton) had very few evening press conferences.
There is a fine line between a reporter asking tough questions and a reporter grandstanding and heckling the President in front of millions of people. No President wants his image tarnished by a reporter trying to play "gotcha" and the ultimate solution may be not to have press conferences at all.
That's up to the White House, I'm surprised that they haven't given him a pass since he Trump seems to like him.
Trump would be having orgasms if he could only have people like Hannity, Jones, and the Trump-loving-talking-heads at his conferences. He probably lays awake at night, trying to figure out how to engineer that little feat. After all, he is PRESIDENT, and should be able to do whatever he pleases, no questions asked.
Maybe he can set up "pretend" news conferences and put people in the audience like Melania, Ivanka, Jarred, Don Jr, Kanye, and a few hand picked stooges. They can have playtime and let him soak in the mock adoration for a while, with no one there to ask him any question that might offend him.
"Mr. President …………. It looks like the economy under you is really taking off, how did you do that ?"
"Well, Jarred, it took a lot of hard work to undo the mess Obama left me with, but, as you know, I put in long hard hours, and never take a day off or go golfing. And, I am very smart, I know big words ! "

An interesting question. I think CNN could argue that Sherrill basically stands for the proposition that a President cannot discriminate against reporters, whether by physical press pass revocation or other form of exclusion. I don't know how a Court would rule on that, because the Court would have to find that Trump's decision not to call on CNN was a form of retribution without due process rather than innocent happenstance. If, moving forward, he wasn't called on without any explanation the White House probably has plausible deniability and would probably prevail in my opinion.
Of course, knowing Trump, he will telegraph his intent and single out Acosta with some foolish tweet proclaiming that he will never call on CNN because of the way Acosta acted or because they brought this lawsuit. If he did so, that would make the case much more interesting. I don't know what the result would be.

I'm not a trump fan at all but Acosta has been a major major D HEAD about how he asks questions for so long now that I hope Trump looks him right in the face and then doesn't take any of his questions.
He's a activist disguised as a Journalist and if anyone can't see that they are simply blind.
All Crooked Trump had to do was not call on Acosta at all which I am sure he'll do in the future. Easy peasy. That's what most intelligent presidents would have done. Yes, there would be complaining from the left just as there were complaining from conservative reporters when President Clinton ignored them back in the day. You don't throw a hissy fit and look like a spoiled brat as Crooked Trump always does.
