Dems got the investigation that they obstructed, protested, cried and whined about, and then what happened? Kavanaugh was confirmed and Trump got what he wanted.
In the end it will lead to Trump getting the wall and when he declares a state of emergency he can get started building that wall right away. Its probably the fast way to get it done when dealing with dictators like Chuck and Nancy.
Even if he does declare a national emergency it will go to court where his own words will be used against him. If it was an emergency he would no have put it off for 2 years. He would not have said that the border "is tight" on Dec 20th. And he will still have to go through eminent domain courts that are still hearing cases from the 2006 border fence bill to gain property.
So even IF he declares a national emergency, and makes it through the first round of court it will likely be over a decade before the wall can even be started in many areas.
The money would be taken from the budgets of other government agencies including 3 billion from the defense department's building fund needed for military construction projects. It is pretty doubtful that the courts would permit the president to reapportion funds as he/she sees fit. The constitution is very clear that appropriations are solely up to Congress. It would be a terrible precedent to boot. Trump, and any president, has to work within the rules the constitution has set forth. It's really elementary. If he can't get Congress to give him the money for a wall, he can't build one.
It will be similar to when the line item veto was disallowed by the courts.
Changing the balance of power between the executive and the legislative branches as it relates to spending would clearly be unconstitutional.
Further, the argument that the southern border today constitutes a national emergency is laughable.
That is very likely where this is heading. If Pelosi and the Democrats refuse to compromise on the wall and then Trump signs the emergency declaration for the border - which has $7 Billion for funding the wall in it - then all this crowing by the leftist media about Trump caving and Pelosi and the Dems winning will be yet another example of 'fake news' being promted by the mass media.
