I agree with bellakin123...I don't think they're actually married...and hopefully "she" doesn't have a leg to stand on....like Sherifftruman said...don't give HER attorney a second thought....but do get some advice from another.
Said couple marries...everything wonderful...letter arrives in mail from his ex-wife(together only 3 months, no children). She states that they are still married.
Said couple pulls out his "divorce papers"...their(him and his exes) marriage liscense was purchased, a ceremony performed, liscense never filled out by minister, nor signed, nor returned to Courthouse.
However, they did sign a peice of paper stating they both agree that they were never "legally married"...everthing has been fine....till now, fast forward 7 years... man remarried, wins some money(a really nice amount) word gets around...
"ex-wife" sends this letter demanding a divorce, alimony, and half of money won.. and has a lawyer stating that her now husband is not legally married to her and that she is entitled to all this, and that if she doesn't get it, she will file bigamy charges.
Now...I KNOW that the man believed he was divorced, he produced what he thought was good papers.
So now the couple who were married just a week after me and my hubby are thinking they are not married, have to file for him a divorce, give up money they won, and have their "marriage" annulled and re-marry....
I be damned. I'd get her for extortion...what say you?
(told you this was drama) and for those wondering, it's not me...We happy as two peas in a pod....
I say this man needs to get himself to an attorney ASAP
Well her lawyer states that because their was a ceremony, and a liscense was purchased, never filed, that shows intent. But the paper they signed said their "common law" marriage is dissolved. well, even if they have to go the divorce way, it's still appears that she's trying something illegal with the money...
What they intended to do and what ultimately they didn't do are completely different. Everyone needs a marriage license to get married so they got one. I find it kind of a sham that a minister showed up and a "married" them but no one signed and mailed the marriage certificate to register.
the ceremony was at their house. Minister never signed the liscense nore filled it out...
Even in their house, if a minister did the ceremony then that's only a religious ceremony, not a legal one, especially since he never filled it out. I guess he was enjoying the party too much and just..opps forgot lol
Wow...you know I have read about how people who win contests, lotteries, etc. have to be careful because "relatives" will show up asking for money, people will purposefully cause auto accidents with them and try to sue, etc but I this situation is wild!
I agree with most: get a good lawyer (or hitman jkjk).
