IF Casey did not have such a history of lying I would have doubts however; she can't even stick to the truth at the trial (no I do not believe her father and brother molested her). With that in mind and the partying she did while Caylee was missing I say she is guilty of Caylee's death, and I do believe it was accidental. That being said my prediction is she will be found guilty of Caylee's death and I HOPE LWOP.
I have not watched all of the trial but have watched enough to see her facial expressions during certain times, and have watched most testimony except when the experts got real boring. I don't think (once they have voted on charge #1) the jury will take all that long to come up with a verdict.

If they go with felony murder, negligent child abuse, she can still get the death penalty.

We will have to see, I think everyone thinks she will not get the death penality, but what really matters is what the jury thinks. This week should prove to provide the answer.

It may be the attorney on the legal team from Jacksonville who handles most of the defense witnesses in the penalty phase. I heard someone on TV at some point say that she has a very strong background in mitigation.

Interesting, the penalty phase also included child abuse, misdemeanor, only five years. That is a lessor charge the jury could go with, only five years. I would have gone with that, if Casey had admitted her part in this crime. Her ongoing denial, and lies are a huge issue to me, whoch is why I would not go with a lessor charge. Death penlty or life.

If she will be convicted of 1st degree...who of the defense team will ask George & Cindy to speak on her behalf, after trashing the parents...maybe only Lee and his wife will show up...

I am thinking the line of people begging for Casey's life is going to be pretty short.

Maybe some wannabe 15min.of fame person who knows Casey.....
The weird behavior of Lee during the memorial service makes me wonder how Lee's mental state is.

The penalty phase is for one thing and one thing only: to determine whether to give a sentence of death or life. If Cindy Anthony is not convicted of a charge that carries the death penalty, there will be no penalty phase trial.

Death penalty cases are divided into two parts. First, there is the trial to determine guilt or not guilty. If the defendant is found guilty of the charge which carries the death penalty as a sentence, there is the penalty phase trial. The jury hears evidence put on by both sides, then (in Florida) recommends to the judge whether to give a life sentence or the death sentence. That's ALL that's considered in a penalty phase. Penalty phase trials happen in death penalty cases only. No other types of criminal cases. That's because, as one U.S. Supreme Court Justice said, "death is different."

If you think the penalty phase trial will be individuals begging the judge not to give Casey the death penalty, you are sadly mistaken. Penalty phase trials became part of the death penalty case trials AFTER the U.S. Supreme Court ruled that the death penalty was unconstitutional back in the 1970s. They did that because the death penalty was found to be unfairly administered, so the states had to revise their methods, which is when death case trials were divided into two separate parts.....first, the guilt/innocence trial.....second, the penalty phase.

The penalty trial is where you will hear experts who have interviewed, tested, and learned about Casey's history and the family history testify about those things. Mental health experts. That's because the U.S. Supreme Court said that in death cases the jury has a right to know personal things about and the background of the convicted person before sentencing.
