i was pulled over for speeding 53 on 30 local and it's my first time caught. I have serveral option now..

1. plea guity: fine + 300 surcharge + 6 points + insurance increase(how much?)

2. plea not guity: attorney fee + fine + court fee(how much) + points + insurance increase


If I represent myself or hire a attorney, what will be the court fee?

You should check (maybe on the DMV website) to see if you can go to traffic school to eliminate the points on your driving record.

So you think you can beat this? 53 in a 30 is pretty bad. On a highway that would be like 106 in a 60, for which you might well be arrested and spend the night in jail. Going that fast in a local is going to completely Mod cut: languagethe judge (who lives there and feels an obligation to protect the community from the likes of you). The judge will also take the cops word against yours.

Are you actually guilty as charged? If so a lawyer isn't likely to be of much help, though they'll say they will be cause they want their fee. About the only way to win a speeding ticket is on a technicality. Maybe a lawyer can find one in your case, but don't count on it unless you really aren't guilty. You might hope for a reduction in the charge (like 49 in a 30 or whatever).

Unless you beat this completely your insurance WILL go up, as well it should. Depending on your record you might get your license suspended.

The court fee is the least of it. Pick up the phone, call the town clerk and ask them.

Hire the attorney. First, you have a massive amount of points there, and I am guessing your insurance could double. Second, the old saying is that only a fool represents himself. Hire someone local to the court who specializes in tickets like this. While he likely will not be able to dismiss the ticket his experience and familiarity with the judge or prosecutor may be able to result in a fine without points.

I guess this all begs the question: Does NY not allow for traffic school?? In CA you are allowed (once every 18 months) to plead guilty, pay the fine and attend a court-approved "traffic school" (usually an online interactive course these days). Once the court receives the traffic school cert the citation is expunged and it doesn't go on on your DMV record or affect insurance.

Question Plead Not Guilty

Was the summons issued by the NYS Troopers...or a local agency......if you got it from the Troopers...good luck...for they no longer allow plea bargaining......if you got the summons from a local agency...plead not guilty - directions on the rear of the summons - and mail the summons to the required address...

Most local agencies allow you to plead guilty to a lesser offense...sometimes without points...you pay a little more money...but no points on your license......a much better deal...maybe even the Troopers will let you plead to a lower charge of speeding...but you won't know unless you try...

If you do get convicted...there is a Defensive Drivers Course offered in NY that allows you to deduct 4 points from your driver's record...costs vary from $25 to $50......and takes 6 hours...good luck
