Not only has Subway fired her, but she should be ineligible for ANY unemployment, food stamps, welfare assistance at ALL because she was fired WITH JUST CAUSE!!!
Is this a just cause??? You want your employers to "Thought Police you?"
Just because you don't like what is being said, in a free society what you say is a personal choice. Whoever does not like it, don't listen. I hope she sues for violation of her 1st Amendment and she won't need food stamps, unemployment, welfare assistance, Subway can pay her freight for the rest of her life.

No first amendment rights are involved. That pertains to what the government can do, not an employer.
Yes this is just cause for a private employer to fire an employee. There are, properly, no 1st Amendment rights regarding employment. It is a private Employment At Will deal either can void at any time.
Well, I can assume the guy who visited the nude spa places was not wearing the company logo, unless it was tattooed on his body somewhere.
People who use social media should be careful what they say and what they take pictures of themselves doing.
This woman said something ugly while in her company's uniform. The firing is totally justified. She also demonstrated an attitude that her employer found he did not want in an employee who is dealing with the public. His customers probably include members of the police force. If I were a cop or a member of a cop's family I would not want her making my sandwich. I would not want her making my sandwich!
This. You can't say something like that and still deal with the general public.

Your 1st Amendment rights begin and end when it comes to the government.
Also Mississippi is an At Will State, an employer can fire you at anytime and for any reason.

Except when you're talking about a business, you're talking about potentially losing out on a whole lot of customers and business due to an employee's terrible rant on social media. People vote with their feet, if what an employee does, either on or off the clock is costing you business, you terminate your relationship with that employee.

She was not at the job. She was on her OWN TIME. On your own time employer has NO right to anything part of what you do and what you don't do.
Do you understand what it means to live in a FREE SOCIETY????? It has the good, the bad and the ugly.
No one, but no one has the right to interfere with your private time. When you are on your private time you are NOT representing your employer or anything or anyone else OTHER THAN YOU AND YOURSELF.
Subway violated her 1st Amendment rights by sanctioning her on her activities outside of work ON HER OWN TIME. This is a great lawsuit.
She's obviously not the sharpest tool in the shed, but I guess "freedom of speech" doesn't apply when you say something insensitive about slain cops (as opposed to Islam).
Free speech doesn't apply because free speech only protects you from retribution by the government for speech. Private individuals and organizations are definitely allowed to take action against speech (with a few exceptions, such as whistle-blowing).

The First Amendment applies to the government, not employers.
