The community I am in has had an on going suit with the Attorney General since 2001. The manager runs the community and the board listens to her. The situation gets worse everyday. Ask a question or for something and you will receive fines in the mail for anything they can write you up for, even if you did nothing wrong. There is no one to complain to but the Attornet General but hopefully he will end this nightmare. It is taking so long and many have already moved away. At all costs don't ever move into a community with a HOA.

Pocono,

I hear you loud and clear. One thing the Board hates is "accoutability" and "responsiblity" and until people start standing up for what is rightfully theirs - they will continue their normal course of events.

Amazing, 9 days after the A.G. was notified we received a letter stating who was on the Board and what their capacities are. It only took them 9 months and an outside agency to get involved, but at least they know when a property owner wants information, they are entitled to it.

The Attorney General is the way to go with HOA complaints. Our case has been on going since 2001, The manager and Board refuse to admit to any wrong. It has been in the courts for the last two years. Once the Attorney General is involved questions have to be answered. Our situation is more involved with the services we receive and the way everyone is treated. You did the right thing, they are not above the members.

Thanks Pocono,

I am glad that you went to the A.G. It seems that some of think they are beyond reproach. I think the next thing we are going to do is have them audit the books. If more people took an interest in doing what is right, there would be no need to contact an outside agency. Everyone deserves to be treated in a fair and equal manner. Everyone has the same rights. The good ol' boys club lives no longer............

Default I Live In A Hoa And They Shut Off My Water--help!

I Live In A Community With A Hoa That Does Absolutely Nothing. However, The Bod Always Buy New Cars And Make Improvemnets To Their Homes Above Their Means. So I Stopped Paying My Dues Because I Refuse To Pay Their Auto Loans. Then I Received Letters That They Will Shut Off My Water Unless I Pay. So I Offered To Pay My Water Portion Of The Dues But They Refused. So Now My Water Is Off Today. Is There Anyway I Can Pay Just My Water Bill Portion Of My Dues Or Are They Correct? I Cannot Afford To Pay The Back Dues Owed!

Home owner associations do shut off water for non payment over a certain amount. What community do you live in, this may help in giving you advice as many go by different rules.

When you ask the Association Attorney (who is now a judge) and you email the BOD three different times over a period of 8 months and are ignored, I think that any member in good standing (up to date of assessments, dues, etc) has a right to know this information. I learned a long time ago, "You teach people how to treat you".

I also thought it was good to post this information for others out there who feel overpowered and bullied by some of these associations - who in my opinion "think that they are above the law".

HighHat, I will be praying for you. I haven't been a member of this forum long so I don't know your specific troubles but my heart goes out to anyone who is having trouble living in a community that doesn't treat each other like they would like to be treated themselves. I hope someone who has some authority can help you sort out this problem.

My heart goes out to you. Life is too short to be that stressed. A home is supposed to be a place you can go relax not a place where you come home and you have a fine in your mailbox or on your door.

Unhappy Child protection laws....Help!

I am wondering if anyone has any advice they could provide. My sudivision has a clubhouse with a pool. The HOA decided that they are going to hire a security firm for this weekend to ensure that everyone has an ID for use of the pool. They have made folks go get their picture taken along with their children(ages 5 and up) and then sent out the IDs to everyone. These IDs have the name, address and phone number even on the childs ID. Now, we live in a pretty tough world where there are predators all over the place. Is there a law that protects us from consenting to the pictures and them not allowing us to use the pool facilities or denying our children the use of the pool. This was just mandated and not part of any of the bylaws when we purchased our home three years ago. I am quite frustrated and I believe there would be some protection for us to channel this through. The president has also hired his mother in law and Sister in law who dont live in the subdivision to check IDs after this holiday weekend. Does not make a lot of sense to me. Help please!!!
