I suspect that the several legal experts that believe it could aid in Loughner's defense disagree with your assertion.

Go ahead, tell that to the guy at Politico who reported it.

I really don't know why some of you attribute articles posted in links to the poster who posted them. So I take it they object and try to make it personal when someone posts articles, news stories they don't particularly care for or want to hear.

See, even the some in the MSM noticed the "story" didn't jibe with the facts.

Giffords

President Obama’s dramatic news at last night’s memorial service in Tucson that Rep. Gabrielle Giffords’ has just minutes before opened her left eye for the first time since the shooting has created some confusion in light of news from doctors that Giffords “could open her eyes” on Sunday.

Then they are wrong, and need to go back and take 2L Evidence.

When someone is metaphorically tossing around gasoline and lighting people on fire, its only natural that they try and put out the flames. Accusing someone of having blood on their hands, or, as Olberman did, accuse republicans and their supporters.

"It is essential tonight, not to demand revenge, but to demand justice, to insist, not upon payback against those politicians and commentators who have so irresponsibly brought us to this time of domestic terrorism, but to change the minds of them and their supporters. To make sure by peaceful means, that those politicians and commentators and supporters, have no further place in our system of government."

"The college students created the logo, and passed out t-shirts for the event, possibly imbuing it with more of a pep rally feel."

UNLESS Obama is called as a witness in the case and appears in court, it's an out of court statement presented for the truth of the matter asserted...which IS HEARSAY.

And it qualifies for no exception to the Hearsay Rule that I can think of.

And you don't think his lawyers would do that - or call the sheriff as well for the out of line statements he has made?

Because it is Obama. No other reason is necessary for you.
The hats, shirts, and wildly inappropriate 0bama supporters at this rally may have tainted 0bama a bit too. BTW, where did the idea for the completely inappropriate slogan-emblazoned shirts and hats come from any way?
