I don't think it is the items stolen that is what is important here. More so, the fact that the thief dared the owner to do something about it. Although, we don't know more, this thief's confidence/arrogance tells me this store has been subject to this blatant criminal activity for a while. More info is needed, of course.
Only someone that was insane would intentionally kill someone over a couple cases of beer. Shooting someone because they stole about $30 worth of beer is crazy, I hope the shop owner gets to prove his tough guy credentials on a daily basis while serving a lengthy prison sentence.
Anyone else recall the Star Trek episode where Wesley accidentally plowed into a flower bed and it turned out to be a capital offense? Picard had to deal with the Prime Directive of no interference and the out of balance punishment for Wesley's crime. Picard opted to bail out on the Prime Directive and continued meddling across the quadrant.
For my part, if I were on the jury for the store owner, I would vote not to convict. There comes a time when enough is enough. Would I feel differently if the thief were a kid? What age would I be more lenient? Is the thief only a thief or is he also a child molester, wife beater, neighborhood terrorist? Juries rarely get to hear the background of punks so I would probably assume this guy was not someone stealing food for his kids but that he is just a punk thief without redemption.
Life is tough. Harder when you are a punk and life catches up with you.
I read the article, which was very slim on details. Where did people get the idea that the guy dared the clerk to do something? That wasn't in the article. However, the article did state the thug was a local gang member, so perhaps the clerk has had dealings with him and his little thug friends before. I'm not justifying it, but can you imagine what it's like to work in a convenience store in a gang-infested area? Probably a little jumpy.
Sheesh, whatever happened to "let the punishment fit the crime".
