Yes it is, but if you kill someone in defense of your life or property it is justifiable... It isn't considered as murder, but instead justifiable homicide..

If he had good buddies/relatives in his gang, then it's very possible they will take revenge on the store owner. Shooting a guy carrying a case of beer is one thing; dodging bullets from four p**sed off 'bangers during a drive-by is something totally different.

You need to call the DA in Whereveitwas, Texas, and inform him/her of your superior understanding of law, because our trigger-happy shopowner is being charged with murder.

It's called having a sense of proportion. The 2nd amendment says nothing about summary execution of shoplifters. I don't think it was left out by mistake. Do you?
