He may yet get off. He wasn't just trying to sneak out the packs of beer - he was daring the owner to do something about it. He dared foolishly. Stealing is one thing, but intimidation while you do it. Well, stupidity has it's own reward.
The laws in Texas are quite "liberal" with the use of deadly force to protect property.
You can for example use deadly force if your neighbors house is being burglarized, this guy was never charged.
This one isn't starting off so well for this guy.
Texas is NOT as gun-friendly as most out-of-staters seem to imagine.
