It isn't. I've noted over and over that nobody trusts Obama with pizza money let alone this kind. Enforce the laws, it's his job.
He has and uses substantial discretion particularly as any encyclopedic enforcement of those statutes is simply impossible...they are funded perhaps to 10 or 15% of the funds needed for full enjorcement. At that point Obama et al gets to use their discretion to determine which are the tasks actually worked on.
The present situation is a fine example. The Immigration courts are already overloaded to the degree that the normal scheduling delay is over two years. Now we have a new burst of immigrants taking advantage of that fact. Obama suggests we try and plug this hole at a cost of about 3.7 Billion. The response from the Congress and the Right is no money. So what can he do? He determines what is a priority and likely will simply ship the children 0ff to family and not worry about it while working on criminals and higher priority offenders.

He can call out the National Guards for a very small fraction of that. Probably for less than government employee's owe in back taxes.

What is it you think the NG is going to do? As far as I can tell their only role will be to hold the baby for the illegal as she signs in with the BP.
The problem is and remains that there are legal requirements to be met to deport these people.

This is nothing new. There is no place near the resource required to deport the lillegals. And there is no good response to the whole crisis but legalization until you get a containable problem. Failure to do this may very well increase the population of illegals. Stonewall another 10 years and we have 20 million instead of 11 million.

Enforce our current laws. The answer to someone who refuses to enforce laws is not to create new ones. We have put people through the process and they are still released. Lots of good it does to process them to just release them.
What is your proposition? Torpedo the rafts? Strafe the wave runners? Actually once they pass the middle of the river they are in the US. Get specific. What do you think the NG does? Lets consider a female carrying a baby wadding ashore. How does the NG stop her? Bayonet?

Absurd. 30 years experience shows the resource is an order of magnitude below that required to actually contain the problem with the existing laws.
the illegals are set free because there is no capability to do anything else. Simple as that.
