This is justification for a lawsuit. Like most left wingers, you left out the fact that she ordered the sperm of a white man and was looking to have a white child.
Like most right wingers, you are trying to turn this into a simplistic racial issue. It's not. She has a case because she ordered 380 and got 330. The race has nothing to do with that.
She very obviously got the wrong "goods"....but I'm not sure how exactly this caused a hardship. You know those two women wouldn't give up that child for anything.

Yes. That is the issue here. She wants to make the case that the townspeople have turned on her like Hester Prynne. I doubt that is true and even it were, is that the fault of the sperm bank? They can't be held liable for how the bigots in the world might act.
Mother is concerned about how her child will be treated in Uniontown, Ohio, population about 2800.
I wonder how " welcoming" this town is to gay parents, let alone a biracial child.
Gonna have a really hard time proving damages in this case.
Negligence, yes.......Damages, No.
The ultimate judicial conundrum. Are white genes more valuable than black genes? If they have the same value then the plaintiff wasn't damaged. Like suing because your chicken laid a brown egg instead of a white one.
I grew up near Uniontown and honestly, I never saw any problem towards anyone who was bi-racial or gay.
It isn't very big and yes, not a LARGE diverse group, but it is the same way for several of the smaller towns near by as still smaller farm like towns that aren't growing as fast as Canton and Akron have, well, had been.

The wrongful birth looks iffy, but the breach of warranty seems pretty straightforward.
