Your thought is incorrect. All it takes is the Governor of the respective states where they are deployed to give them the power/order them to arrest.

What we have here is a large group of people who live in constant fear. They are terrified of school kids and now, seemingly, terrified of poor, desperate people fleeing violence in their country much of which is a direct result of U.S. policies.
They are clearly so fearful that their brains, much like the president's, simply cannot process reality in any meaningful way.
It would be sad if their way of thinking wasn't so dangerous.
If you think that it's only refugees coming here you are badly mistaken. Criminals, economic seekers and those from known terrorist countries, etc. are slipping in right along with them according to the former FBI Director. We cannot keep taking in hundreds of thousands of refugees or illegal aliens. Enough is enough!! We don't have the resources and jobs for all of them. We don't have an endless supply of taxes and natural resources either. I'm tired of our country being the flophouse and employment agency to the whole world. It's the US military, they have tents for the troops to stay in. The military will not be taking prisoners, so they won't need to house them.

Trump is so unoriginal. Follows the same move of the preceding two presidents as both Obama and Bush sent the guard to the border to assist.
