1. As I have already pointed out to you elsewhere, since "impachment"="charged with a crime," yes he has been charged with a crime.
2. As I have also already pointed out to you elsewhere, the senate trial is his trial. So as of next week he will have gone to court over it.
In any case it's an "opinion". Let the Congress impeach him over it if they think he broke the law.
