I agree it's a sad situation but why is a 13 year old out in the middle of the night with a loaded gun. The parents have some responsibility for allowing this situation to materialize.
Charge and arrest the parents.
If a 13 year old broke a window in my house, the parents would be responsible. Make the parents responsible for this one carrying a gun in the wee hours of the AM.

Decades ago when I taught Middle School, a 12 year-old I had was arrested, cuffed, and placed in a police car. The officer proceeded to give him a speech about changing his evil ways. While he was talking, the kid grabbed the car door and intentionally jerked it shut, banging the cop's head between the car and the door. The cop pulled the kid out of the car and beat the crap out of him, then took him to juvenile hall.
After he was released, the kid came to me asking advice on how to bring charges against the cop. I told him: "You got what you deserved". He responded that he would "take out" the cop.
This kid was extremely anxious to get to prison because his dad and uncles had told him how awesome it is!
Better dead.
