Harm is not a prerequisite for determining whether a criminal act has been committed. No one is "harmed" as a result of a person being publicly intoxicated, no one is "harmed" by painting graffiti on a public wall. Criminal act can be nothing more than an offense against the public's sensibilities. Your criticism would be more appropriate after someone has been charged and convicted and the question of appropriate punishment comes up.

well, as another poster stated Wal Mart only cares about the color green and not the enviromentally friendly green. So they will squash this story as much as possible.

The article never said "hate crime" they used the word bias which alludes to but is not the same as 'hate' legally.
