So can I safely tell her something like "Could I take you out sometime, maybe have some dinner?" even when most likely the guy she lives with is her boyfriend?
The two times that we have talked she has never mentioned him.

Yes. As of right now you don't have a clue if she is single or not so just ASSUME that she is, or at least pretend like it if you don't think she is. If she hasn't told you yet then you have nothing to be wrong about. I figure you might not be as much of a home wrecker as me. Personally I wouldn't give a damn who he was even if it was her man. But that's me. You could just flat out ask her if she is talking to anyone right now. If she hasn't mentioned him before then you may be lucky, it's most likely a 50/50 chance if him being her BF or not at this point. It's nothing wrong with hanging with a friend of the opposite sex, boyfriend or not. Just flirt with her a bit, see how she reacts, then ask her if she wants to do something this weekend or tomorrow night or whatever.

No. That's not aggressive or desperate. That's normal.
I still prefer my idea. Ask them both out. You think that it is her boyfriend, so assume that it is. If she tells you that it's not her boyfriend then you smile and say, "even better".
Or next time you see her you can always just ask her, "is that your boyfriend that I see you with"
If your interested, just ask her if she is single. That simple.
