No a law against open marriage CANNOT be enforced. If you think it can please elaborate and tell me exactly how YOU would enforce that law and what the consequences would be.
Do the same thing they do with prostitution you set up sting operations targeting known hangouts for swingers. You can also set up a website front like ashley madison the advertises places to meet for people in open relationships. If the government wants to be crafty about it....they can do it. Now i don't think it's likely, but i have seen some stories of overzealous prosecutors doing some crazy stuff too.
Maybe for rhetorical effect, but no, it's not a true oxymoron. The words "open" and "marriage" are not inherently contradictory. Your beliefs and morals may make them personally contradictory, but that doesn't change their own inherent relationship to each other.

The voting process should determine what bests helps a society move forward.....it shouldn't determine how people live their lives in their own homes however.

I have already made my point. Just because the men you know are (obviously) not monogamous does not mean that there are not monogamous men out here.
