Exactly what I was thinking! Graybill now says that McKenzie always barks at him no matter whether she was in the yard behind the gate, loose in the front yard, or in the house. No matter what she barked at him. If that is true, then the fact that she didn't bark at him on 12/24 would have been unusual wouldn't it? This is a huge contradiction. I think Graybill is well meaning, but there a lot of inconsistencies in the different accounts that he gave.

I've said I believe he is guilty and that his appeal will get shot down, I think ohyesidid said it perfectly, the defense, prosecution and the Modesto PD were a mess.

A few things irritate me though, get the robbery date and time right, it really isn't that much to ask, nor should it of been difficult. Don't report it happening at 6:30 am on 12-26, that's insulting. At least act like you are pursuing as much as you can, especially if a felony takes place across the street from another felony within hours possibly. When a guy like Steven Todd tells you he robbed the house on the 27th, and you tell him, no they were home, he then says it must have been the 26th between 3-7 am and you take it as the truth? We know it didn't happen after 5am since reporters were already there. Hey this guy has been arrested 37 times let's take his word for it, c'mon man. No matter what you think about the lady who saw the safe with 3 guys on the 24th, is it really fair to shoot her down but believe every word a career criminal says? Sloppy police work at its finest.

Ted Rowland's, the reporter who was all in on Scott being murderer, still is I believe and the first reporter on the scene on the 26th has basically told MPD not to insult his intelligence and change the time from 6:30 as it's currently reported, to before 5am.

The other part is the publicity, you can't have 50-80 million citizens know that Scott Peterson went fishing that day in the bay, you just can't. The MPD leaks were atrocious, the cops smelled bleach on the night of the 24th, no they didn't, then you have Scott linked to other dissapearence's from 10-15 years ago? That stuff makes it out to millions of people, and it's why half the prospective jurors said Scott was guilty from the start.

Then you lose a bunch of jurors because of the penalty, why?? So many check marks have to be checked for a case for the death penalty, appeals go on and on. Plus, because it's a death penalty case you can be assured that once the California State Supreme Court gets done with it, it will also be reviewed by the US Supreme Court. Does anyone want a case based solely on circumstantial evidence going to the US Supreme Court?

Scott Peterson will likely die on death row, there are over 700 inmates currenty on California's, if not, we're getting closer to the Feds banning capital punishment anyway which means he'll have a much better life on death row than a convict who's in general population.

Guilty yes, but why make it so difficult?

You left out the media, James. They aren't entirely responsible but let's not forget the role they play in what information is given to the public.

I don't believe the nonsense that has been put forth on the Scott Peterson Appeal series. It all starts with the premise that Ted Rawlins is right, and the police are wrong. The series then goes on to build an entirely new set of facts based on an unreliable claim from a reporter. The series should be renamed: Scott's fictional account of the facts and how it relates to his last appeal.

" Does anyone want a case based solely on circumstantial evidence going to the US Supreme Court? "
Answer: rarely is a trial not based entirely on circumstantial evidence [note: DNA evidence is circumstantial evidence], so sure, why not.

The reporter is mistaken.

I watched the whole series and all I kept saying to myself is why didn't Geragos present all this stuff at the trial?

I really do believe he is guilty. I think if Laci was not pregnant he probably would have just kept up with his behavior but after having a baby he knew he would have more responsibility at home and could not freely come and go as he pleased.

His actions to me is so obvious he did it. He got rid of Laci's car not too son after she was gone and then started ordering porn channels?? And not too mention the call to Amber during his wife's vigil! He knew his wife was not coming home.

My heart does break for the Rocha family, not only did they lose their daughter but their grandson.

Did you read the original? I didn't. I skipped by it because it was too hard to read. So then I thought you know, that's a new poster to this thread and it would be nice to get some new blood here so I scrolled back and put in the paragraphs hoping more would read and respond. Unfortunately New Poster hasn't added anything since.

Yes, Geragos got paid a whole bunch of money and he's supposed to be one of the best criminal defense attorneys in the state. He has his own cream-of-the-crop investigators. If there was credible exculpatory evidence, he would have presented it at trial and he would have found a way to make more than one juror (the guy who left due to alleged threats) see how it would exclude Scott from being the killer.

I don't really understand relying on Scott's behavior to say he's guilty. My mom died on a Friday, I was back to work on Monday. Does that prove that I didn't love her? I went back to work because being around people and being busy was a better alternative than sitting at home alone crying. Nobody knows how they will react when tragedy hits. No one.

As for calling Amber during the search for Laci, he thought she didn't know who he was and what was going on. Maybe she was a way to feel a bit normal again in the midst of all that was going on. Granted, he was super creepy on the tapes, but we didn't hear the whole tapes. Maybe they talked about "normal" things. I also don't have a problem with Scott and his dad not talking about the trial when the dad visits. They've been talking about this for 12 years and Scott now has a team of appellate lawyers working on his appeal, so his next steps are covered.

I've always thought this which is why 1st Degree for Laci but 2nd degree for Conner never sat well with me. I believe Conner was his target and Laci was collateral damage as his host.

Condolences of losing your mom while you found a way to recuperate.

Laci was missing and Scott insisted she was alive somewhere, but he wasn't looking for her. So porn helped him console himself while his wife and child were missing.

The time and effort it took continuing his charade with Amber should have been put forth to locate his wife and child. An innocent person would have prioritized. Selflessness would be the only priority in order to save the lives of loved ones.
