Background checks are unconstitutional. The whole point of the 2nd amendment was so the public was better armed than government, for a reason. There is no way the founders wanted an eventually overbearing government, to know who had what weapon.
If you think the public has a chance of being better armed than the government, you are dreaming. Your local gun shop would need to start carrying attack helicopters, RPGs, tanks, heavy artillery, smart bombs, WMDs, etc.
The FBI, if they submit to the NICS background check. But that's the point - only the law-abiding are affected. The criminals won't be affected. They won't submit to a background check. It's already illegal for the buyers in your example to possess firearms. It's already illegal for anyone to sell them one. So they'll steal one or buy illegally or from the black market. If they have no qualms about murdering someone they sure as hell won't have a problem stealing a gun, etc. No new laws will affect them. The laws already on the books aren't being enforced like they should be.

You are correct on this one. There are roughly about 40,000 rejections each year. Do you know what that means? It means each of those 40,000 people have committed a felony punishable for 10 years and $100,000 fine. Do you know how many of those 40,000 the almighty and righteous government have prosecuted?

As inept as the bureaucracy is, I would guess that several thousand were rejected because of an error. I know personally that I have never been arrested. The only time I was fingerprinted was in the Army. But when I bought a new gun last December, my background check didn't come back in the 3 day period, so my purchase was approved without it as the law says to do. I did buy a 22 rifle since then and it went through in 10 minutes. But I have no idea why it was held up the first time.
Yet he was not put in prison for committing a felony!
