ASSAULT - In criminal and tort law, an act, usually consisting of a threat or attempt to inflict bodily injury upon another person, coupled with the apparent present ability to succeed in carrying out the threat or the attempt if not prevented, that causes the person to have a reasonable fear or apprehension of immediate harmful or offensive contact. Any D.A. who prosecutes one who was defending person or property is either ignorant of law (a valid possibility today) or is an accomplice after the fact with the injured perpetrator(s).
He is certainly not "securing rights" for there is no right to threaten, assault or injure the person of another.

After seeing the whole video (with audio please) a rational person cannot lay any fault on Alba. No way. Plus I highly doubt without cherry picking things to death a jury can be found who would convict Alba of anything. Let alone murder. I've run up against snot nosed DA sand ADAs out to prove a point and make a name for themselves and was lucky to witness the harsh rebuke handed them by a good judge.
But an NYC judge already backed the DAQ with the initial bail amount at 500,000. Then that was dropped to 200,000 then finally to 50.000. If anyone should have been ORd it's Alba. But noooo. They'll release violent druggie repeat career criminals but try to throw the book (and the table it's sitting on) at a guy like Alba. It's infuriating and it's good to see the regular citizens of NYC furious at this. That's change in the making.
I had always thought there was no hope for NYC. Along with LA San Fran Fresno and a host of others. But maybe just maybe if the citizens of NYC get mad enough (this could do it) that binjo ditch of a city can get cleaned up.
Meanwhile our resident "self defense expert" (who is probably just trolling) is indeed good comic relief.
The D.A. will probably try to bully Alba to take a plea deal, to save face.
On the other hand, predators in government will defend other predators and prosecute any prey that dare to fight back.
I hope that he doesn't take any plea deals and fights it.
The DA and judge should have their law license revoked and they should both be removed from their position. Both should be required to put in community service hours in a bodega in the worst criminal neighborhood for no less than 4 hours a day from 8pm to midnight every Friday and Saturday until they’ve put in no less than 40 hours.

He certainly should. Nothing less than total exoneration will do thank you. Alba needs to rub Bragg's nose in it but good. Baaaad dog! No cookie! The DAs office will play hell finding a jury in NYC that will convict. The circumstances here are even more plain than in the Rittenhouse case. And the NYC DAs office will look more foolish than Kenosha's did. Which is pretty bad. :dubious
