Proportionality, for one. If someone is throwing marshmallows at you, a person is not privileged to shoot the thrower. Immediacy is another. You can't wait to use deadly force.

None of what you mentioned is deadly force. So why use deadly force to defend against such?

You are uninformed/ignorant/misinformed about self-defense law in NY state. I have already explained specifics about that. Not doing it again.

I think you do people a disservice if you are teaching self-defense law when you obviously don't understand it.

A quote from you: "Nope. He was just yelling. That's not life or death."

Anyone who has seen this video knows that the attacker was not "just yelling." You're flat-out misrepresenting the facts here.

Initially, he was. Which is what I referred to.

So, you think that someone should have to wait until they're actually being killed to justify defending themselves?

This is NY DA mentality......

And reason #4251 that I don't live in NY anymore.

This is Hamilton Heights. It's not the most pleasant place. Workers are constantly getting attacked. That poor girl at the Harlem Burger King, shot and killed over nothing. Anyone working in these places should have a reasonable fear that when a dispute happens and some knucklehead comes around the counter to your cashier side and shoves you, that your life is in danger.

People need to remember this DA and hold him accountable.

This is all well known by the people that live and work in that area, lots of violent, sometimes fatal beatings.

A decent lawyer is going to trot out a 61 year old man, note the size and age disparity, note that they said (remember the gal was there too) were going to eff him up, cornered him and note how especially in that neighborhood getting beat to death is a real possibility.

He defended himself with what he had on-hand.

Jury is going to barely have enough time to order lunch before acquitting that one.
