Just in case people are wondering, there have been a number of cases where the egg donor, surrogate, birth mom or whatever either in the case of adoption or invitro etc. has either gotten cold feet or put demands on the couple like some sort of custody agreement....or even brought suit later on.

I only bring this up to give examples of some of the pitfalls that these guys have avoided doing it this way, especially if they feel they may be legally vulnerable that some surrogate might come along later and find a judge willing to take the kid away from the two "gay dudes" when he's 3.

That was nice of her especially since carrying a baby at that age can have many complications.

There must not have been a well written contract or one at all in those situations.

Grandmothers having their own grandchildren does sound weird, but this stuff has been happening for at least the last 10-15 years, if not longer. Most of the cases involve a parent in their 50's or 60's, whose daughter couldn't have children or had their uterus removed entirely. This is just a different spin on it, a grandparent having their grandchild for their gay son.

I believe the main issue stemmed from when these things were done without contracts.

However, even with a "well written" contract we can both imagine that there could be many ways to try to get around that. Heck, I knew someone who had a short marriage and on divorce the other party wanted custody even though it was the persons kid from another marriage.

Long story short, it was a financial shake-down attempt. They were going to drag the other person through court unless they got paid off to go away.

(I guess I hang around lawyers too much, makes me hear a lot of rarer BS that we'd normally not see)
