It wasn't a murder. Excessive force was used by the police, but they were not trying to kill this man. Had he not resisted arrest this wouldn't have happened.

Actually, had he not been a low level street criminal his entire adult life this wouldn't have happened, either.

How exactly I "made it seem" like Al Sharpton does great things is beyond me, but my position is quite the contrary. He's a fool. He makes a fool of himself and a mockery of all that is good and normal about black Americans whenever he opens his mouth.

You did a bang-up job of assuming quite a bit with this long, spaced out group of half-sentences, but most of it is simply blather and completely wrong. I for one don't want a "Caucasian" (I'm not causcasian) Al Sharpton. I'd be utterly embarrassed if an Al Sharpton-esque fool started speaking for white people.

Correction, I'm not only Caucasian and I'm certainly not obsessed with tying all parts of my being to race as racialists insist on doing.

I'm wondering something else about this case. I have heard the man died of cardiac arrest. If this is so, why didn't the paramedics attempt CPR or those defribulators? Was he already dead by the time they got there?

Help me understand something. If I had done this to someone would it still be considered murder? Can I claim that I used excessive force for a now deceased individual that I asphyxiated. I mean my intention was not to kill the person we were just having sex (The painful kind you know).

The man was not resisting and if he was you do have the right to resist an unlawful arrest because it is assault and battery against your will similar to rape (says the supreme court not me), therefore the crime isn't being committed by you. Had the police been doing their job like we pay them too instead of worrying about a former felon then none of this would be happening TO ANYONE the deceased victim, his wife, kids, the officers on a high protein diet, and last but not least US NEW YORK CITY TAX PAYERS who will have to dish out a large sum of money to his family due to the senseless actions of another.

This wasn't an unlawful arrest. And in NY, you DON'T have the right to resist an arrest that YOU decide is unlawful.

how was the arrest unlawful? The narcs told him what he was being arrested for. Also, you don't know what the video didn't record...

Resisting an unlawful can be a very risky thing. In most states, it will still be a crime to resist a police officer, even if the arrest would be illegal. It can be very difficult to know under what circumstance, if any, it is permissible to resist arrest and what amount of force can be used.
