I can 100% guarantee you that this will be their strongest defense. That NYC had abrogated its duty to protect its residents and that this was a direct consequence of that. It's a stronger defense than many would give it credit for.

it easily could have happened to me if i beat that guy with that club in the park that day ….
don’t forget when it’s us under pressure we perceive everything as a greater threat then it may be once fight or flight kicks in ..
it is way to easy to over access what the situation demands in the face of an unknown threat . .
it is up to the court to say what a REASONABLE MAN would have done …but the problem MASSAD said is courts are not under that same flight or flight syndrome you were nor can they feel the stress of the situation.
so they are really looking at it like a west point graduate far removed from the battlefield and the fog of war ,so what they see and feel is not the fear on the front line . and that is your proverbial reasonable man . a man uneffected by fear , fight or flight and perception of the unknown outcome .
most of us would not think twice about using deadly force even if the situation was such that it just meant an ass whooping if it could save us from the unknown outcome and we would feel justified .
but our laws and courts have a different view.

i doubt he will get away with less then a plea deal on a manslaughter charge
