The ex-marine’s lawyer was on WABC radio shortly after the arrest and he said he was confident his client would be cleared. I don’t think that was a wise statement unless he was told that by the prosecutor’s office which I doubt. There is no way to predict how a grand jury or a trial jury will rule and the lawyer doesn’t know what evidence will be presented in court. Also this lawyer ran against Bragg for D.A. so the case may become personal between him and Bragg.
Some people compare this incident to the bodega case where the clerk stabbed a guy to death but he had been physically assaulted first. Jordan Neely hadn’t touched anyone and didn’t have a weapon before Daniel Penny grabbed him from behind. I don’t see how he can be cleared unless a jury ignores the facts and wants to make a statement about the perceived threat of mentally ill people on the subway.
Oh yeah, I forgot about that.
Still I think he has a good chance of walking. Fund is over 2 mill at this point and its not stopping.
