Only idiots would disregard the fact that drugs and his resulting physical health can play a big part in contributing to his death. Neely talked a big game by threatening people, but he was in poor physical shape to back it up.

From all reports Daniel Penny took him down from behind by surprise. It was hardly a fair fight to sneak up to someone who doesn’t expect it and put them in a headlock.

It's hardly a fair fight to act in an intimidating manner in the subway system, where the average person is: a) helpless; and b) has an actual agenda other than stirring the pot.

The chances of me getting choked out by a Marine on the train for the rest of my life is probably 0.0001%. Why? Because I don't act like an uncivilized savage on the train bothering others. Even if I was homeless and frustrated with life, I would be still be cognizant not to bother others.

Why is it only a certain group of homeless that constantly act out onto others? Did the homeless-loser have to be choked to death? No. Was it his own fault? Yes. Am I glad I won't EVER have to deal with this aggressive vagrant on the train? YES! And for that I am grateful for the Marine's service. Mind you if the vagrant never threatened anyone on the train I would have much different thoughts.

Unless you’ve read the official report, “from all reports” just means hearsay.

When you act like a big tough guy threatening a bunch of people, you are going to run into someone who is bigger and badder than you that will beat your azz down, so yeah, it shouldn’t have been unexpected from Neely’s standpoint.

an ass beating is one thing for it …
there would be no issue if he got his ass kicked for his actions


someone killing him for it when only an ass whooping is required is a whole other thing..

that is what manslaughter is …you didn’t mean it to happen , it was more force then needed in response or your action caused his death .

my co workers son was not allowed in a 7-11 in long island where he had run ins ….

well he went in anyway , got in to a squabble and hit the clerk who fell backwards , hit his head and died .


he is in prison for manslaughter

Any kind of beating can result in death. Plenty of people have died from just one punch or even a shove. If you don’t want to be killed, don’t get into any fights. If you don’t start nothin’, there won’t be nothin’.

yep and the result is usually the same , manslaughter charges….

that is the definition of it.

anytime you cause the death of another whether accidentally or on purpose and deadly force was not being used against you , you face manslaughter charges.

now it’s up to a judge and jury and the DA .

us arguing the facts is irrelevant

No, it’s up to the jury. The DA already decided. Anyway, he can be charged but he should be acquitted or get a reduced sentence in light of the fact that Neely was the instigator and aggressor.

not necessarily up to the jury …he can try a plea deal.

my own opinion is he should get jail time .. at least two years…

deadly force was not needed ..this was a case of an ass whooping being called for and no more then that .

the fact he died by neelys actions whethe accidental or not makes it manslaughter
