I wonder how truckers and their CB's managed all those years without clowns calling for a total ban on all talking in a moving vehicle? And I wonder what they would say?
Have a law, have a punishment, most people will comply, those who don't might have to pony up some $$ even if they don't get into an accident, and the rest will drive recklessly no matter what. That's the best you can ever hope for.

I would imagine that in any state that allows for prosecution of drivers for negligent vehicular homicide the use of a cell phone as the contributing factor for a fatal accident would already be liable for criminal prosecution.

Wow, that almost makes sense. I mean truckers are professional drivers certified by the DOT. There are 10,000X as many automobile drivers on the road.

I don't know why hands free is an issue. My car has manufacturer built in bluetooth that activates my phone through the console system and sound system. I can control my phone through the steering wheel and even have voice dial on the steering wheel.
I never feel distracted talking in my car, anymore than I would be singing to the radio.

So explain why hands free cell phone use is bad. Is it just the sheer number of cars? That alone accounts for more accidents, cell phone or not. Plus obviously passengers have a right to use them and can be used as a GPS and in emergency situations as well. There can't be a complete ban, it's stupid.
