I can guarantee you Bob. If you were flat on your back with someone straddling you, holding you down with their weight, you'd be pretty worried. It's one of the most frightful experiences you can have if you don't know how to get up, or don;t have the strength to do it without skills.
Have someone demonstrate this on you to get a feel for it. You can't duplicate the fear factor of having a stranger do it at night outside.
I am wondering at what opportunity GZ had to identify himself? If he is sitting in his vehicle observing, and it's raining, why get out? When TM started running, there was no opportunity at that point.
Silly me. I was under the impression that GZ had a vehicle that had windows that rolled down.
Yeah, why get wet, when you can stay dry until you get out to find an address.

No, the law says a "reasonable" fear. Little kids fear the bogeyman, all sorts of things. One of my kids once started screaming b/c a moth was flying around in her room. Was GZ's fear "reasonable"?
The bogeyman and moths ? How about a more reasonable analogy that'll probably happen thousands of times today.
Car accidents. For 5, 15, 45 seconds today thousands of people will have a 'reasonable' fear of imminent death or great bodily injury as they skid, go off the road, just miss someone who jumped a light, etc. Some will die or suffer greatly. Others will have a broken nose, a strained neck, scratches, or no injuries at all. That doesn't make their temporary imminent fear unreasonable. Some with injuries will go to the hospital, others won't. That doesn't negate the reasonableness of their fear at the time of the accident.
It's going to be interesting to see the closing arguements.
Does anyone know if the defense is going to use their video animation to clairify their version of the timeline and events to the jury?
