Supposedly, an OH doctor referred the family to an out of state abortionist instead of contacting OH CPS for further instructions. CPS would have known that abortion is legal in OH under these circumstances.
Why would CPS send her out of state for an abortion when that wasn't necessary?

CPS got involved BEFORE the law changed in Ohio, so they likely didn't know if it would be legal or not. These abortion laws are vague and badly written. Abortion in Ohio is allowed for medical emergencies, but it wasn't clear if this would qualify or not. Other OH laws that talk about medical emergency in regards to pregnancy talk about things that present an imminent risk of death. Her death was not imminent. Why should the doctor take the chance of a felony if he's not absolutely certain that it's allowed? Why should he take that chance if he didn't have to? Why blow up your profession and life if there's an alternative?

It all depends on what the actual story is.
A) A 10 year old traveled across state lines to get an abortion. The helps the pro-choice supporters.
B) An illegal alien raped a 10 year old girl and the parents tried to cover it up to avoid deportation of the rapist. This helps the immigration/border voters.
The 10-year-old told police Fuentes was responsible for her pregnancy, Huhn testified. Assistant Franklin County Prosecutor Dan Meyer said the girl had recently turned 10, meaning she was likely impregnated at 9 years old.

Read OH's law yourself. It specifically allows abortion in the event of a threat to the mother's health. Any MD would have signed off on the fact that carrying a pregnancy to term is a physical threat to a 10 year old girl's health.
