I'm curious on a legal basis I wonder if the cops can be held civilly liable.? I suspect and hope not.

Also I'm wondering do folks think shooting a gun is like some sort of video game where 100% accuracy is assured?

From 10 or less feet? I would hope for cops to be able to group 2 inches in a ten ring. Most cops only shoot enough to requalify and that is exactly why you see so many stories of cops emptying their weapons and scoring so few actual hits. Their weapon is a stranger to their hand.
That said the sheep should have dropped to the ground and cleared the line of fire.

Perhaps they do meet the minimum standard. The standard is too low....

Most likely not, as they were acting under the authority of the department. NYPD is liable, they are personally not.

You'd be surprised how many people simply freeze when something like that happens. The shock of it all, and the rapidity of it, just leaves them unable to move, sometimes for several seconds.

I'd like my comments in this thread to be shown anybody calls me "anti-police." We need officers. We don't need to criticize them when they're having to make life or death decisions on the fly. This is one of those instances.

All this craziness yesterday over the Empire State shootings and it appears it was the NYPD doing all the shooting. Mayor Bloomberg should stop worrying about gun control across the country and worry about his own back yard.
