Here is some better insight into what the plaintiff team's legal strategy is going to be here:
Trump argued that social media companies have “ceased to be private” companies and cited the Section 230 protection shield that such firms employ to protect themselves from liability. Republicans have argued that the federal rule has allowed Big Tech firms to censor their political opponents—while some have gone further, arguing that social media giants should be regulated as utilities.
“This lawsuit is just the beginning,” Trump said of the suits.
Section 230 of the 1996 Communications Decency Act allows internet companies to be generally exempt from liability for the material that users post. The law, which provides a legal “safe harbor” for internet companies, also allows social media platforms to moderate their services by removing posts that, for instance, are obscene or violate the services’ own standards, so long as they are acting in “good faith.”
Trump’s lawyers said the lawsuit will focus on provisions in Section 230, which they argued was created in the 1990s to protect children from harmful content online. The way in which Big Tech firms currently use the law as a shield, his team argued, oversteps what it originally intended to do.
“They are not immune anymore,” lawyer Pam Bondi said.
Well I think the impeachment trial kinda did that when it showed him hate tweeting about Pence at the same time rioters were in the capitol attempting to assassinate him.
Don't you think it will be priceless to have him explain those types of tweets under oath. It's must see TV for me, can't wait.
If Twitter and Facebook lose their legal immunity, that will all but destroy these two platforms, at least as far as they currently operate. Google's situation is more complicated, but YouTube could be similarly affected.
Of course the neutering of these platforms would not end the discourse, it would just cause it to be less centrally controlled and more widely distributed. Which for our society and the promotion of free speech and political discourse, would be a very good thing.
Trump's Facebook lawsuit is filed in federal court in Florida. Facebook's terms of service requires that "any claim, cause of action, or dispute you have against us" be filed in federal court in northern California or San Mateo County state court.
Trump's Twitter lawsuit also is filed in Florida. Twitter's terms of service - which courts generally enforce - require that "all disputes related to these Terms or the Services will be brought solely in the federal or state courts located in San Francisco County."
Cases have been thrown out for this before. Ask Laura Loomer.
Now, are Trump's lawyers really this stupid, or is this just a fundraising ploy???? I think we all know the answer to that. If they were serious they would have filed the cases so that they would reach the court. These never will, but it will keep the saps happy believing otherwise. This thread is ample proof it's working.

Twitter has no ability to control where and when any lawsuit is filed. It's laughable and indicative of their profound arrogance.

The dispute is not with the "Terms and Services" of Facebook and Twitter, but rather with the impact on the first amendment rights of plaintiffs of the abuse and misappropriation of the Section 230 legal liability protections (federal law) by these dominant social media platforms.
