I'm not on EB. I'll get my full check tomorrow, thankfully! And I know they owe me.
When congress was slow acting in June, I couldn't go on EB because I'm in California and they triggered off EB. The only option was the pull forward.
I understand they owe me. My thing is this:
If they hadn't started a 2nd year in Feb and just continued my 1st yr (like they were supposed to) then I would have been in early Tier 2 in Feb. Right Now, i'm in my 1st week of tier 4. If they hadn't paid me those 13 weeks, wouldn't I still be in Tier 3?????? Like EARLY tier 3?

this week is about 31 weeks from 2/27. so, depending on where you were in Year 1 Tier 2...not sure. the max Tier 2 can be is 14 weeks. Tier 3, 13 weeks.
it doesnt SOUND like you could be in early Tier 3 using where you were last year.

you started getting $224? what did you lose by having to cut back another $179 for the last 31 weeks?
what did others lose? a house? car? insurance? thats lawsuit material for some, i'm sure.

You can't sue the government without their permission. You would have to exhaust administrative options first which means an appeal. The last appeal I had many years ago, the referee rested his palm in his hands, wouldn't make eye contact and I overheard him yelling on the phone that he didn't care what Raleigh did they could just keep overturning him.
He was a very, very bitter man and yes he did get overturned but what happens is they just send it back to him to correct. THEN you appeal his decision again THEN you appeal to the Commissioner, THEN you appeal that.

Well what's strange with that is the fact that you had a waiting week? You only serve a waiting week when you get put into a new year.
So if you didn't monetarily qualify, then you shouldn't have had to serve a waiting week.
Possibly only a week for the pullforward to run, which I believe used to be on Wednesday evenings.
You'll really need to call and talk to a rep with this one, I have no idea how this affects you .,when apparently you feel you didn't ever recieve anything in year 2

I'm scared to call. Honestly, I need to see a doctor first then see what letters show up. I can't take it emotionally right now.
I filled out a new claim on 5/11 and didn't get paid for that week and had a waiting week after that. So it was for a new year but I don't have the letter handy to verify 26 weeks.
The "missed" week I was told would role to the end so I would still get it but not upfront. Anyway, I had to do a fresh application online to get it started again and that's why I didn't get paid for that week I guess.
Ironically, I wonder how many people might become emotionally unable to look for work which will make them ineligible for benefits.

yeah, we all had to wait a week for Year 2 to start. thats the first time i ever heard it was going to roll to the end. frankly, that sounds like a way to feel like you arent really missing out. the length of benefits is the length of benefits, and a waiting week is a delay.
2nd Year Tiers generally arent as long as in Year 1.
i dont think we can make any educated guesses on your case without knowing what your Monetary Determination letter said in May, 2010.

You are absolutely right. I lost a house. My husband who is in the Marine Corps just found out last week that he's getting kicked out because of a heart condition. He's 28. We have a 1 yr old and a 3 yr old. We are 2500 miles away from home (NC). I know what people have to lose because I feel like we've lost most of it.
